There are many legal forms that your NGO could take. How do you know which one is the best for you?
There are no real statistics on the number of NGOs in the country. The estimates vary widely, with a recent article putting the number at over a million. And less than half of these are legally registered.
Before we go further, what exactly is an NGO? Short for Non Governmental Organization, NGO is not an easy term to define. Generally, they are taken to be not-for-profit organizations that work on one or many developmental issues. Way back in the ‘nineties, the World Bank tried to work out a comprehensive definition of the term (see box).
The fact is that you do not have to register an NGO to do not-for-profit, developmental work. But being a legal entity helps, particularly when you want to get funding of some sort, or when you want to make the organization big, bring in professional management or when you want to work in certain sensitive areas.
| What is an NGO? |
| “The diversity of NGOs strains any simple definition. They include many groups and institutions that are entirely or largely independent of government and that have primarily humanitarian or cooperative rather than commercial objectives. They are private agencies in industrial countries that support international development; indigenous groups organized regionally or nationally; and member-groups in villages. NGOs include charitable and religious associations that mobilize private funds for development, distribute food and family planning services and promote community organization. They also include independent cooperatives, community associations, water-user societies, women’s groups and pastoral associations. Citizen groups that raise awareness and influence policy are also NGOs.” - World Bank |
Where do I register?
There is more than one way in which you can register an NGO—four to be exact. You can register as a society, a trust, a cooperative or as a not-for-profit company.
All these come under separate Acts—Bombay Public Trusts Act of 1950, The Societies Registration Act of 1860, the State Cooperative Societies Act or the Multi-state Cooperative Societies Act or the Companies Act of 1956, specifically Section 25 of the Companies Act. The process, per se, is quite similar under all the Acts; the difference being in where to get registered and other procedural details, like the minimum number of people required, the documents required, jurisdiction under which registration is possible, mode of succession of management and such.
Now the question is, which of these options should you go for, given your circumstances? Why should you choose, say, a society over a trust or a Setion-25 company?
“There are merits and demerits attached to different Acts. It is difficult to pick any one and say that this is the best form to get an NGO registered. It all depends on the requirements of the person or the organization seeking registration”, says Rodney Ryder, a practicing lawyer and partner with FoxMandal Little.
Choosing the right Act is not that difficult as there are certain characteristics of all the Acts that are specific to some circumstances.
Public or Charitable Trust
A trust is the easiest to get started with as the minimum strength required to form a trust is just two—the author and the trustee. And the author could also be the trustee. So, if you want to start small or if you do not have many people who share your vision or objectives, then a trust is your best bet.
For a trust to be formed, there has to be the author or the person at whose instance the trust comes into existence, a clear intention by the author to create a trust, a purpose for the trust, property belonging to the trust (usually bequeathed by the author as part of the trust deed, to start with) and beneficiaries of the trust. The ownership of the trust is divested by the author in favor of the beneficiary or the trustee. A trust is set up on a basis of a trust deed and cannot be dissolved unless it is provided for in the trust deed. Trusts also get tax exemptions on parts of their income.
Charity is a matter of state jurisdiction. So, different states have different legislation in the form of trusts or endowment Acts to govern and regulate public charitable trusts. For example, the Bombay Public Trusts Act, 1950, governs all public charitable trusts in the state of Maharashtra. Other state acts are more or less similar to the Bombay Trusts Act. In case a state does not have a specific Act, then the general principles of the Bombay Public Trusts Act, 1950, apply. There are also private trusts governed by the Indian Trusts Act of 1882. But that is outside the scope of this discussion.
Between a trust and a society, a trust offers more democracy and transparency than any other form of registration, but the fallback for a trust is the fact that all the trustees are equally empowered and one dissenting partner can be the cause of the trust to become non-productive.
“When it comes to a trust, the Act empowers all the members, better known as trustees, equally. Though there is a head of the committee designated as the chairman, all the decisions, under this Act, are taken after discussion with all the trustees. This sometimes can end up in delays and the functioning gets cumbersome,” says Rodney Ryder.
“A trust is like a partnership—one for all, all for one. Whereas a society is similar to sole proprietorship—one person makes all the decisions and the work is fast”, concludes Ryder.
In terms of documentation, the main instrument for the registration of a trust is the trust deed, which sets out the aims and objectives of the trust, the number of trustees (a minimum of two) and other details about your trust. While registering, you would be required to be present personally to submit these documents to the charity commissioner of your state.
Society
A society requires a minimum of seven individuals to come together and may be wound up if three-fifths of the members of the general body so desire. Societies are registered under the Societies Registration Act. While this is an all-India Act, each state has its own variations. In Maharashtra and Gujarat, for example, all societies must also simultaneously be registered as trusts under the Bombay Public Trusts Act, 1950.
As per the law “every society registered under the Societies Act may sue or be sued in the name of the president, chairman, or principal secretary, or trustees, as shall be determined by the rules and regulations of the society, and, in default of such determination, in the name of such person as shall be appointed by the governing body for the occasion.” However, “if a judgment shall be recovered against the person or officer named on behalf of the society, such judgment shall not be put in force against the property or against the body of such person or officer, but against the property of the society.”

we are a Not-for-Profit organization based in Manipur, India and we are working for the cause of Global warming and climate change. Recently we have started a campaign called Plant a Million Tree and we are getting good response from every section. We have in fact started our plantation
and at the same time, we have our plantation of Cymbopogon Citratus and we extract essential oil also thus creating lots of employment for the underprivileged section . we have our own product of Cymbopogon Citratus oil and Cymbopogon Citratus Tea and we give a free gift of 1 vial of oil
and 1 packet of tea to each and every volunteer every month. and in return, we take a small amount of donation or membership fee of INR 100 from every volunteer every month in order to achieve a successful plantation.
we would now like to expand our volunteer base at the same time we would like to raise funds in order to successfully implement our endeavor. we are now in search of good partner NGO or firm who can help us achieve our target. we can supply our product to our partner (1 packet of Tea and 1
vial of Oil) whereby the partner has to sell the product and raise fund. 55% of the fund shall be utilized in our campaign and 45% of the fund generated shall be kept by the partner firm as working capital. for your reference, the market price of a 50 g packet of tea is INR 88. we are supplying a 100 g packet plus a complimentary 1 vial of oil and the MRP would be INR 100. basically, this will cost more than INR 200 in the market.
our products are of superior quality and the oil is of the highest grade and the Tea is of superior quality where it is green and smells fresh lemon.
Uses of Lemon Grass (Cymbopogon Citratus)
Lemongrass is the source of Lemongrass oil, a good source of natural citral, which is used as a basic raw material for synthesis of ß-ionone used for synthesis of a number of useful aromatic compounds and ?-ionone for synthesis of Vitamin. Lemongrass oil is thus used as a main substitute
for ‘Cod liver oil’.
It is widely used in perfumery industry for manufacture of various grades of Perfumes, Soaps, Detergents and Cosmetics.
Cymbopogon Citratus oil is known for its calming effect that relieves insomnia or stress and induces sleep. Cymbopogon Citratus oil is used locally over rheumatic joints, lumbago and sprains.
Cymbopogon Citratus oil mixed with twice its quantity of coconut oil is a stimulating ointment for rheumatism, lumbago, neuralgia, sprains etc. In chronic cases, the undiluted oil may be used for better result. Cymbopogon Citratus oil has got anti-microbial, anti-fungal and anti-bacterial
properties and hence is effective in treating athlete’s foot and other fungal infection. It is also considered as a mild insect repellent. Just soak cotton with Cymbopogon Citratus Oil and place it in the four corners of the cupboard and you won’t have any fungal infection in your clothes
and it will also smell fresh lemon. Add few drops of Cymbopogon Citratus oil into plain water and spray it to you room and it acts as a wonderful natural room freshner.
In 2006, a scientific research at the Ben Gurion University, Israel discovered citral (a substance in Cymbopogon Citratus) caused apoptosis in malignant cancer cells, meaning the cancer cells would kill off themselves ( a cell suicide). Citral not only caused cancer cells to kill themselves
on a Petri dish (shallow covered dish used for culture of bacteria etc.), it caused no harm to normal cells that were present. More amazingly, the quantity of citral used in this experiment was equivalent to one cup of tea cup of tea using 1 gram of Cymbopogon Citratus in hot water.
Cymbopogon Citratus tea can help with poor digestion, stomach aches, gas, bowel spasms, and diarrhoea. It is said to be a mild sedative and can calm nerves. Because it contains vitamin A, it can be helpful in keeping the eyes and skin healthy.
Cymbopogon Citratus tea, with pepper, can help relieve menstrual problems and nausea. It can promote perspiration and lower fever or cool the body in high temperatures. It also helps lower high blood pressure and cholesterol levels. A study done at the University of Wisconsin revealed
that some people taking prepared Cymbopogon Citratus Tea daily for three months experienced a significant reduction in cholesterol levels, and that their cholesterol levels returned to their previous highs when they stopped taking the preparation. Obviously, this indicates that Cymbopogon Citratus may help reduce cholesterol in certain individuals.
Cymbopogon Citratus tea has been an ancient remedy for curing chest congestion, colds and coughs. A well prepared Cymbopogon Citratus Tea is a very good remedy for a patient to get rid of common cold.
Interestingly, Cymbopogon Citratus Tea benefits in acne prevention and in dealing with other skin problems too. Studies have shown drinking Cymbopogon Citratus Tea on a regular basis, prevents the skin from developing any acne or pimples. This is true, as acne is a result of bacteria, and the anti-bacterial natural of the tea, helps the skin to look good and feel good. There is a plethora of Cymbopogon Citratus Tea uses. This folk medicine has to have some truth, since it’s been used for so many years. To make a start, combat the cold, with a cup of Cymbopogon Citratus Tea.
Use Cymbopogon Citratus Tea in moderation as excessive use is likely to create other complications.
Cymbopogon Citratus essential oil may irritate sensitive skin and for this reason should be used with care during pregnancy.
Awaiting for your favourable feedback.

The Home for the Aged Homeless
Mariam Sharifan is a foundation working in and around the city of Lahore, Pakistan as a shelter for the aged shelter less since 2005. It is a non-profitable trust that has very high passion for elders and aged.
This is one of our basic cultural values to pay high respect to our parents and elders, but due to distortion to the value, many of our elders and aged are seen homeless and rejected. Those how have been killing themselves for the better future of their offspring through out their lives, many times are destined to spend their last days of lives not only without the love and care of their love ones but also with out the roof. At this age, they are old, weak, sick, loveless, careless, foodless and homeless etc that makes them lifeless too.
We over here have neither any kind of social security system nor any provision in the law to take care our aged. Our aged is the sole responsibility of their children. That is according to our cultural heritage is true. However, in this part of the third world this treasure of value is changing very rapidly due to illiteracy, unemployment, poverty and mixing of cultural values that are unavoidable.
Mariam Sharifan foundation not only accepts and welcomes the aged but also tries to become the source of hope for the elders and aged, “the hope to live and love themselves”. With the help of locals, we generate some funds, get some house on rent, keep our aged together and serve them by sparing time, providing food, clothing and medicines, etc.
Mariam Sharifan foundation shares and spreads this passion to not only individuals but also tries to lift up this esteem value of the cultural heritage by extending, arranging and educating the locals through seminars.
Mariam Shrifan foundation always seeks opportunities to approach the families that are victim of this natural disorder. Wherever there is any miss understanding among the family members and the elders, it tries to resolve the issues amicably and re-enforce the love that the parents renders to their children.
ELDERS AND AGED ARE THE BLESSING OF GOD is the motto of Mariam Sharifan foundation. Its vision is to exalt and keep high the respect and dignity of human life. Nobody has the surety of life but in reality, elders and aged spend their average life span and usually stand at the edge of their earthly life. Mariam Sharifan foundation tries to let them pass through this earthly reality with full honor and grace.
Mariam Sharifan foundation requests and appeals to all (regardless of age, sex, race, country, color, culture and religion) to keep on praying for its efforts for the dignity of human life. It also welcomes you all to enrich it with your valuable suggestions, as well as financial support.
Mariam Sharifan foundation appeals and request for the donations and funding to build, make and run a proper house for our elders and aged. This holy obligation is for the sanctity of human life.
Kindly do ask any kind of question, if you want to support us fully or partially.
Thanks

Subject:- help to ngo for making a shelter home for orphaned street children & old age home
Dear Sir/Madam

we a inamdar abdul rahim patel organization is a, not- profit and non -Governmental organization in karanataka . Though the organization is established legally registered on1995 and registration Number 181/karanataka/94-95 by the state Government of karanataka Established by dedicated professionals who were working in different child focused organization before. Some of them were experienced orphan & vulnerable life so far, the number of street children present in the boundaries of gulbarga is over 2500 and the situation is really pathetic & inhumane. We are presently looking for financial support, as for our mandate so that we can take up the activities in the benefited of the distressed children. However our present program is running under 'karanataka State AIDS control , which is based on behavioral change in the street children. Furthermore, we understand that for overall development of street children there untouched, we believe that you and we share same missions & good & you will be happy to extend to us the financial support. If you have any queries about our organization please feel free to have communication & sharing. Anticipating a favorable response AMREEN ngos mission is to provide care, love and development for children living on the streets of chittapur GULBARGA
We strive to help as many children as possible and focus on those in most urgent need.
We assist children with their immediate challenges, such as homelessness, malnutrition and illness, while also developing their attitudes and skills so they can make a better future for themselves.
We reach over 1000 children daily through our street schools,MADARSSA vocational centers. We want to do more.
AMREEN NGOS is a fully registered, non-profit, non-governmental organization. It was established in 1995 and employs a staff of seventy dedicated local people. Salaries are modest, the office is small, and we stretch our funds to maximize their impact. Unlike many other organizations, AMREEN NGOS has little savings, but spends what it gets. The annual budget is about $200,000.
The eleven-member Board is elected bi-annually and consists of doctors, professors, social workers and community members
AMREEN main activities are the provision of:
•an information/advice help line for children in need
•repatriation of children to their families
•temporary and permanent homes
•medical care and sanitation
•nutrition
•emotional support and counseling
•education
•vocational training
•awareness, advocacy and research

The idea might be against the past and current trends but NGOs need to think from this angle. A sense of bartering and less obligation is always there.
A collaborative efforts with communities for the latest trends either in Health care / Education can be looked at.
I would appreciate those interested individuals to go through our web site and ask as many questions to arrive at RIGHT CAUSE for our communities.

MASSAGE ON 4TH OCT 2009 ANIMAL DAY from Bright Future Social Welfare
Organization Badin.
Badin is district head quarter of Sindh province, lies at 240 39 North 680 52, east’s. Badin is small but important town in southern Sindh Pakistan. This district lies, 93 km (58 miles) east of Karachi, 98 km (61 miles) west of tharparker 50 km (31 miles) south east of Hyderabad.
This district is divided into five Talukas such as Badin, shaheed fasal Raho, Matli, Talhar, Tando Bago and dehs 497, UC 46.
This area based on agriculture, life of people that is farmers, kisan, zamindar totally depends on agriculture, live stock,, fisheries, man crops sugar can, cotton , wheat, rice, chilies and so on.
In district Badin the most of income of peoples depends on domestic animals such as buffalos, cows, goats, sheep, camels, donkey etc.
Buffalos:
There are three types of buffalos found in district Badin:
1.Black buffalos
2.Brown buffalos
3.Black and brown buffalos
Cows:
Is the second interested animal of the people because the milk is thin instead of buffalo.
Goats or sheep
This is most common domestic animal cash crop because their races increase very quickly. It is estimated about 75% goats are died every year due to diseases,
There are about 885 dairy forms in Badin. In each dairy form about 07-200 buffalos under care but still the demands of milk is not fulfill due to week animals and poor diet, there are about 07 weakly animal sale point and yearly one donkey sale point on country level from where people earn money for the safeguard of life.
Many buffalo’s kids died at birth or after birth due to lots of reasons. It is about 20% new born buffalos died due to unknown reasons.
There are 50 % animals died every year due to non-availability of medical facility that is the major loss of poor people who depends on live stock.
The other reason of death may be the improper diet of animal and mixture in the diet of animal. The second reason is drinking water due to shortage of water for animal use and use of dirty water cause diseases because there is no proper arrangement of drinking water.
Hygienic condition
The environmental pollution, rain fall, sanitation water cause mosquito and insects in places or congested dairy form that cause so many diseases and death of animals.
There are very few animal dispensaries in Badin which are in far filing areas, non-availability of medicine, and diagnostic lab. Poor people can consultation from doctor for their animal but they cannot afford the cost of medicine.
Future plan of BFSWO
1.The proper arrangement of free consultation for animals
2.The Bright Future Social Welfare Organization wants to participate with shareholder and who want to help them.
3.Hospitals should be established UC vice
4.Shelter and drinking water
5.Proper sanitation arrangement
6.Spray to kill the mosquito
7.Provide natural environment (plantation, grossing)
8.Arrange for diagnostic lab for Taluka level.
Bright Future Social Welfare Organization is working for the betterment of social and non-social animal but due shortage of financial aid this organization feel handicap. Appeal to national and multinational donor who are interested in social services of mankind and non-social animal.

The Foreign delegation of USA, Japan, India, Singapore, also included and praised the work of Mehraj Khushal Das with association of D.M.Maharaj to brought the statue for exhibition to Karachi and they offer that, the exhibition of statues made by may colleague be held Internationally.
At least 42 Channels of the Media Telecast the exhibition of statue of Shaheed Muhtarma Benazir Bhutto and presented their views on it. DCO and EDO Badin were appreciated our efforts to make arrangement for bringing the statue to the Karachi for displacing in exhibition.
On 2nd September 2008 a member discussion had been held in Sindh Assembly on the statue of Shaheed Muhtarma Benazir Bhutto and it as decided unanimously that the culture department will held the exhibition off the statue all over the country.
The leadership of PPP show their burning desire to fix the statue at Bilawal house for the remembrance of Shaheed Muhtarma Benazir Bhutto which were accepted by us after that statue was carried to Bilawal house with full protocol.
It is also appealed that in the days of Shaheed Zulifiqar Ali Bhutto the Ministry of Minority Affairs had initiated the Policy of awarding awards and financial assistance to artisan so that they can continue their work with keen interest. It is prayed that we may be benefited for granting financial help so that we can serve the benefit to nation.
It is further stated that the artist Mehraj Khushal Das has also made a statue of former Indian Prim Minster (late) Rajiv Ghandi and to donate it to the Ghandi family as a good will gesture from country and for this foreign affairs ministry may be directed to make necessary arrangement for this purpose.
PPP Co-Chairman and President of Pakistan Mr. Asif Ali Zardari also convey good wishes for us for noble work and assure that, Whenever he visit to Karachi, he will inaugurate the statue to install in Bilawal House for ever remembrance of Shaheed Muhtarma Benazir Bhutto.

Dear Brother and Sister
I am Qaisar Anwar Founder and President of Trust Of Humanity Foundation Pakistan, More than three thousand armed people attacked on Christian homes in Gojra Christian town on August 1, 2009, town situated in diocese on Faisalabad, after the earlier attack on Christian houses in Village Korian, 5 to 6 km from Gojra town on 30th July.
More than one thousand people held a procession in the main city of the Gojra town at about 8:30 AM on August 1, 2009. They were demanding death sentence of Talib Masih who is charged of false blasphemy in village Korian. Thousands of Muslims attacked on Christians in Gojra after the procession and opened fire on the innocent Christian people indiscriminately.
The Christians being week could not resist attack and more then 60 houses completely burned and looted from the houses and set every thing on fire. A Pentecostal Church situated in Christian Town was completely burned.
One Hameed Mashi, 50, who was fired with a bullet in his head died at the spot. His family members were gathered around his dead body. The extremists reached there and threw. All of them died and completely burned.
Two women were present at their home and they were also set on fire. They also died at the spot.
18 people have been injured. And they are hospitalized with no care in the hospital.
Following are the names of the dead:
1. Hameed Mashi
2. Akhlas Mashi
3. Asfa Bibi
4. Victoria Ashi
5. Seema Bibi
6. Umia Bibi
7. Unknown Child.
The situation in Gojra is still tense. There are announcements continued in the mosuques about attacking the Christian Colonies and Villages in this area.
Non-cooperation from the district administration and negligence of the law enforcement agencies has caused this problem.
The immature attitude of the Christian political leadership has added to the misery
(Poor Christians of Gojra seeking your help and support only 500$)

The city of Mathura was ruled by King Ugrasen. He had a son named Kansa and a daughter Devki. Kansa jailed his father and forcefully became the king of Mathura. Kansa married off his sister to Vasudev who was one of the officers in is army. On the day of wedding Kansa heard a heavenly prediction that the eighth son of Devki will be born to kill him he decided to kill his sister also. But on Vasudev’s pleading he imprisons both of them on condition that they will handover all their children to Kansa. Kansa killed all the six new born babies of Devki and Vasudev but the seventh child Balram was saved by divine intervention as the child was transferred from Devki’s womb to that of Rohini's. When Krishna, the eighth son of Devki and Vasudev, was born as if by a sheer miracle, all the soldiers guarding the couple fell asleep and the gates of the dungeon flew open themselves and Vasudev smuggled the child in a basket to his friend Nand in Gokul. On the way he had to cross River Yamuna and it was raining heavily but the five headed serpent Sheshnag protected the child with its fangs. After putting the child near Yashoda who had that time given birth to a girl child Vasudev returned with the girl child to the dungeon. On hearing the news of the eighth born child, Kansa rushed to kill the girl. He held the child by her legs and just as he was about to bang her against the wall, the girl vanished into thin air and told Kansa that his slayer had been born and was safe. Krishna grew up as Yashoda and Nand’s son in Gokul and later killed his maternal uncle Kansa, freeing all the people of Mathura from his tyranny. He also liberated his parents from prison and reinstated Ugrasen as the King of Mathura. Lord Krishna also later played an important role in the Mahabharata War.
This day is concrete of truth and all men kind fellow the way of lord kirshna and shree munth bhagwont geeta

Subject – Grant –in –aid to the society.
Dear Sir,
It is to submit that our beloved " HEM DHONDIYAL" , site engineer was electrocuted and expired at the age of 21 yrs while supervising construction works in Century Pulp and Paper Mill { Birla Group} Lalkuan [ Nainital].
In his memory, we have formed a society named " HEM MEMORIAL SOCIETY
( REGD)" with the aim to serve old aged and disabled people. So far we have registered about 42 nos. of old aged (senior citizens) and disabled people. For them we have arranged their accommodation, furniture, recreational items (audio- visual), exercise equipments, library ( books and news papers) indoor games equipments, helper, etc. with our own resources . With the result we have succeeded to reach upto needy people.
Sir, we are new in this field. We are doing our best but how long ; could not understand? But still we promise that we will not loose our hearts. We will help elders and disabled till our last breath. That’s a promise to our self.
Our society took pain to provide old aged / widow/ disabled pension from govt to needy people. We have all records with us. (If required all records and project proposal will be submitted in time.)
We are providing medical aids to old and needy people with our own resources.
We can perform still better but for want of finances, feeling handicapped. I therefore request your honor that grant- in- aid may be extended for this noble cause. It will be recorded and audited properly in the societies account. A line in this regard will go very high. On hearing from you, we can send required proposals and other records along with project report on this account.
Thanking you in anticipation.
Yours Faithfully

THE GREENS
K.N.C. Road, Barasat
North 24-Parganas
Sir / Madam,
We, the members of “The Greens”, are involved in some trekking expeditions in various trekking routes in Himalayas. While running these expeditions, we felt that the remote and inaccessible villages of Himalayas are starving for general medicines and most of the essential commodities for a person having needs to lead a normal life.
In the previous year 2008, we have organized two Medicine and Useful Commodity donation camps in Reeh village (Altitude – 2132 Mtrs.) and in Gangi village (Altitude – 2500 Mtrs.) of Tehri district, Uttaranchal successfully. In this year 2009, in our next expedition (Har-ki-Doon – Borasu Pass – Chhitkul) we are also going to organize Medicine and Useful Commodity Donation Camp in the village “Osla” (Altitude – 2700 Mtrs) of Uttarkashi District, Uttaranchal, in the verge of “Tamasa valley”.
To make this event possible, we need some serious financial help from you. Therefore, we would request you to donate generously for the said purpose. We believe that your effort and co-operation will satisfy those needed people.
Thanking you,
Yours sincerely,
(Souvik Pal)
